Any order taken for a product appearing in the online store of the sitewww.naudet.com (hereinafter THE VENDOR SITE) implies consultation and prior acceptance of these general conditions of sale. Clicking to validate the order implies full acceptance of these terms and conditions. This click has the value of a "digital signature”.
PURPOSE
The purpose of these terms and conditions is to define the rights and obligations of the parties in connection with the online sale of goods offered by THE SELLER to the consumer.
CONDITIONS RELATING TO THE HANDLING OF EQUIPMENT ENTRUSTED FOR QUOTATION
Refusal of quotation : A charge of €30 will be applied. This fee covers the expertise required to draw up a detailed quotation, as well as the cost of returning the appliance. Withdrawal : If you refuse the quotation, you may choose not to collect the device. In this case, no charge will be made and the device will become the property of NAUDET.
Device management : Please note that NAUDET will dispose of the device after a period of one year from the date of the quotation, if you do not respond to our reminders.
ORDER CONFIRMATION
Contractual information will be confirmed by e-mail to the address indicated by the consumer on the order form.
PROOF OF TRANSACTION
Computerized registers, kept in LE VENDEUR's computer systems under reasonable security conditions, are considered as proof of communications, orders and payments between the parties. Order forms and invoices are archived on a reliable and durable medium that can be produced as proof.
PRODUCT INFORMATION
Every effort has been made to ensure the accuracy of the information presented on THE SELLER SITE. Nevertheless, THE SELLER or its suppliers shall not be liable for any consequences, incidents or special damages resulting from electronic transmissions or from the accuracy of the information transmitted, even if THE SELLER was aware of the possibility of such damages. Product and manufacturer names and brands are used for identification purposes only. Product photos, descriptions and prices are not contractual.
VALIDITY OF OFFER AND PRICE
Our prices are valid for one day.
TERMS OF DELIVERY
Products are delivered to the address indicated by the customer on the order form and only in the geographical areas we serve. It is the consumer's responsibility to be present when the products are delivered: in the event of the consumer's absence, NAUDET cannot return products that have not been received without first having received the products. Shipping costs for a second shipment are due prior to dispatch.
All products leave our premises in perfect condition. It is the customer's responsibility to inform the carrier (or letter carrier) of any small traces of damage (holes, crushing, etc.) to the parcel, and if necessary to refuse the parcel. A new identical product will then be returned to you free of charge.
The exchange of any product declared, after the fact, to have been damaged in transit, without any reservation having been made on receipt of the parcel, will not be accepted.
As with any shipment, it is possible for the product to be delayed or lost. In such a case, we contract the carrier to start an investigation. Every effort will be made, for as long as necessary, to find the parcel. If necessary, the retailer will be reimbursed by the carrier and will deliver a new identical parcel at his own expense. We cannot be held responsible for longer delivery times caused by the carrier, particularly in the event of product loss, bad weather or strikes.
DELIVERY PROBLEMS CAUSED BY THE CARRIER
Any anomaly concerning delivery (damage, missing product compared with the delivery note, damaged package, broken products, etc.) must be indicated on the delivery note in the form of a "handwritten reserve”, accompanied by the customer's signature. At the same time, the consumer must confirm this anomaly by sending a registered letter with acknowledgement of receipt to the carrier within (2) two working days of the delivery date, setting out the aforementioned complaints. The consumer must send a copy of this letter to the SELLER'S ADDRESS. Without this report, we will not proceed with any exchange.
DELIVERY ERRORS
The consumer must notify the SELLER on the day of delivery, or at the latest on the first working day following delivery, of any claim of error in delivery and/or non-conformity of the products in kind or in quality compared to the information given on the order form. After this deadline, all claims will be rejected. This claim may be made to the SELLER'S ADDRESS. Any claim not made in accordance with the rules set out above and within the time limits specified will not be taken into account and will release the SELLER from any liability to the consumer.
In the event of a delivery or exchange error, any product to be exchanged or refunded must be returned to the SELLER as a whole and in its original packaging in perfect condition to the SELLER'S ADDRESS. To be accepted, all returns must be reported and have the prior agreement of the SELLER, who in case of agreement will resend the package to the correct address. Shipping costs are at the SELLER's expense, except in the event that the product does not correspond to the original declaration made by the consumer in the return form.
PRODUCT GUARANTOR
The present provisions cannot deprive the consumer of the legal guarantee which obliges the professional seller to guarantee against all consequences of hidden defects in the thing sold. The warranty period is 2 years (two years). Excluded from this warranty are all products modified or repaired by the customer or by any entity other than the service providers chosen by the SELLER.
The warranty may be extended in accordance with the terms and conditions set out in the store and on the website in the workshop section.
RIGHT OF WITHDRAWAL
The right of withdrawal applies only to natural persons.
In accordance with articles L. 120-20, the consumer has a period of fourteen (14) calendar days to return, at his own expense, any products that do not suit him. This period runs from the day of receipt of the consumer's order. All returns must be notified in advance to the SELLER's customer service department. The product must be returned to the SELLER'S ADDRESS.
Sensitive products (such as DVDs, CDs, software) must not have been unsealed, in order for the consumer to benefit from the right of withdrawal.
Only products returned in their entirety, in their original packaging, complete and intact, and in perfect condition for resale, will be taken back. Any product that has been damaged, or whose original packaging has been damaged, will not be reimbursed, taken back or exchanged. This right of withdrawal is exercised without penalty, with the exception of shipping and return costs. In the event of exercising the right of withdrawal, the consumer has the choice of requesting either a refund of the sums paid, or an exchange of the product. In the case of an exchange, the return will be at the consumer's expense. If the right of withdrawal is exercised, the SELLER will make every effort to reimburse the consumer within fourteen (14) days.
RIGHT OF USE
The use of trademarks on this site is strictly prohibited.
LOYALTY PROGRAM
Our site offers a loyalty program. This program allows you to accumulate points when you place orders :
1. Each order earns 1 point 2. Each 10-euro purchase earns 1 point 3. When the 20-point threshold is exceeded, you'll receive a 5% discount on your next order (cannot be combined with any other discount). 4. Earned points are deleted 12 months after the last order. 5. Only the number of points that trigger the discount will be deducted from your points balance.
REFER A FRIEND PROGRAM
The sponsorship program enables the "sponsor” to introduce NAUDET to his "godchildren”. These sponsors and their "godchildren” benefit from discounts according to the following terms and conditions :
1. In the case of a referral, the "godchild” receives a 5% discount on his or her first order from a purchase of 50 Euros (excluding shipping costs). 2. When the sponsoree meets the conditions for a discount, his or her sponsor automatically receives a 5% discount on his or her next order. 3. A sponsor can have several godchildren: he then accumulates the discounts granted to him by his godchildren up to a limit of 10% per order. 4. When registering, it is important to use the same email address as the referrer.
FORCE MAJEURE
Neither party will have failed in its contractual obligations to the extent that their performance is delayed, hindered or prevented by an act of God. Force majeure shall mean any irresistible event or circumstance, external to the parties, unforeseeable, unavoidable, beyond the control of the parties and which cannot be prevented by them, despite all reasonably possible efforts.
The party affected by such circumstances will notify the other within ten working days of becoming aware of them.
The two parties will then meet, within a period of three months, barring impossibility due to force majeure, to examine the impact of the event and agree on the conditions under which performance of the contract will continue. If the case of force majeure lasts longer than one month, the present terms and conditions may be terminated by the injured party.
The following are expressly considered to be cases of force majeure or fortuitous events, in addition to those usually accepted by the jurisprudence of French courts and tribunals: blockage of means of transport, earthquakes, fires, storms, floods, lightning, stoppage of telecommunication networks or difficulties specific to telecommunication networks external to customers.
PARTIAL NON-VALIDATION
If one or more stipulations of these general terms and conditions are held to be invalid or declared as such in application of a law, regulation or following a final decision by a competent court, the other stipulations will retain all their force and scope.
NO WAIVER
The fact that one of the parties does not avail itself of a breach by the other party of any of the obligations referred to in these general terms and conditions of sale shall not be interpreted for the future as a claim to the obligation in question.
APPLICABLE LAW
These terms and conditions are governed by French law. This applies to both substantive and formal rules. In the event of a dispute or claim, the consumer should first contact the SELLER for an amicable solution.
PROTECTION OF PERSONAL DATA
All the data you give us is used to process your orders. In accordance with the French Data Protection Act no. 78-17 of January 6, 1978, you have the right to rectify, consult, modify or delete any data you have provided to the SELLER. This right can also be exercised online.
DISPUTES
Any order placed via the VENDOR SITE implies the customer's unreserved acceptance of the VENDOR's general terms and conditions of sale. In the event of a sale to a legal entity, any dispute relating to the sale (price, terms and conditions, products, etc.) will be subject to French law before the Commercial Court of the SELLER's registered office.
